All models, actors, actresses and other persons that appear in any visual depiction, whether of actual or simulated sexual conduct or otherwise, that appears on the website were eighteen years old or over at the time of the creation of such.
The operators or owners of ebonylog.com are not the "producers" (either primary or secondary) of any content that may be explicitly sexual in nature, regardless of authenticity, that is shown thereon. The operator of ebonylog.com limits their activities with regard to sexually explicit content contributed by third-party users to transmission, storage, retrieval, hosting, or formatting only. All content that is furnished by third-party users is displayed on areas of ebonylog.com which are under the control of those users. For this reason, the operators and owners of ebonylog.com are exempt from compliance with Section 2257 records keeping and labeling obligations as declared in 28 C.F.R. §75.1(c)(4). In accordance with Title 18 U.S.C. §2257(h)(2)(B)(v) and 47 U.S.C. §230(c), the operators of the website reserve the right to remove any third-party images or videos deemed by the website operators to be indecent, obscene, defamatory or inconsistent with their policies and/or terms of service.
Any visual depictions that may appear on the website, for which the operator of the website may be regarded as the “producer,” are not subject to the stipulations of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not include any sexually explicit acts as outlined in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not include depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not include simulated sexually explicit acts; or (4) the images or videos were shot before July 3, 1995.
The operator of the website has appointed a custodian to be the keeper of original records as necessitated by 18 U.S.C. § 2257 and 28 C.F.R. Part 75. The records are in the care of said custodian and can be inspected by sending a request via our contact form.
